Content of the Arrangements (What? Who?)
These issues can be categorized into different areas. Various instruments are available to address these matters in each area:
- Medical Treatments and Procedures: Both during your lifetime and after death, questions arise regarding how you or your body should be medically treated. Who will answer these questions if you are no longer able to do so? A living will is the instrument for bindingly setting forth your wishes and preferences in this regard.
- Representation and handling of legal matters: Who will make decisions for you in personal, financial, and legal matters if you are no longer able to do so? The power of attorney serves to regulate representation in the event of loss of legal capacity. You can appoint an executor in your will to act on your behalf after your death.
- Distribution of assets: You can specify how your personal assets are to be distributed in your will (or in a contract of inheritance if you have jointly arranged your estate). The distribution of death-related lump-sum benefits from the 2nd and 3rd pillars is governed by the (foundation-specific) beneficiary declaration.
- Funeral: You can specify your preferences regarding your funeral—including the type and location of the funeral as well as the desired circle of attendees—by means of a written funeral directive.
Prerequisites for Action & Access Rights (How?)
It is one thing to plan your future in detail and to designate who will be responsible in the event that you are no longer able to do so. It is, of course, quite another matter to ensure that your arrangements are actually carried out. Do you have an overview of all the legal transactions you have entered into?
